BEYOND DISGUST #20 ~ THE HISTORY OF HISS & ABU KABIR

There seems to be a lot of information on Yehuda Hiss that never got out of Israel for many good reasons as you will read below. This information does not mention bodies from any but those of wounded IDF military personnel, however having been so protected and involved all along the way of his ghoulish career one can only wonder.

He is also suspected of being involved in the stealing thousands of Yemeni Jew babies and, upon telling their parents the child was dead, and issuing death certificates, selling the infants to infertile Ashkenazi Jewish parents primarily in America.

No matter how you put it, this man is a ghoulish, psychopathological creature with friends in high places.

Soldier’s Family File Suit Against Dr. Yehuda Hiss

Dr. Chaim and Dina Buzgallo, the parents of soldier Ze’ev Buzgallo who was killed in a Golan Heights military training accident, are filing a petition with the High Court of Justice calling for the immediate suspension of Dr. Yehuda Hiss and that criminal charges be filed against him.

Hiss serves as the director of the Abu Kabir Forensic Institute. Ze’ev was killed in an IDF training accident on Apr 15 1997. Following his death, his body was sent to the forensic institute. According to the parents, the body of their son was used for medical experimentation without their consent, experiments authorized by Hiss.

An official complaint was filed at the time with the IDF leading to a three-month investigation that involved Israel Police. The investigation led to a recommendation that criminal charges be filed against Hiss. An criminal indictment has yet to be handed down in the case.

Following the publication of the recent Yediot Achronot investigation into alleged wrongdoing at Abu Kabir, pointing to the very same alleged actions by Hiss, the Health Ministry launched its own investigation that has led to Attorney General Rubinstein ordering a police investigation against Hiss at this time.

Hiss serves as the nation’s chief medical examiner. Attorney Darshan-Leitner, who is representing the parents of the soldier, is calling on the court to order the immediate handing down of a criminal indictment against Hiss based on the former case, unrelated to the findings of police in this latest case.

Darshan-Leitner also represented the Sinclair Family of Scotland against Abu Kabir. In 1998, the Sinclairs charged that Hiss removed the heart and other body parts from their brother Alexander’s body, using them for commercial purposes. In that case, a settlement was reached by which the forensic institute made a compensatory payment to the family.

Maor Calls For Hiss’ Suspension

The revelation of illegally stored body parts in the Abu Kabir Forensic Institute has prompted MK Maor, chairman of the Knesset Science Committee, to demand the immediate suspension of the director, Prof. Yehuda Hiss.

Maor stated that suspending the director is a prudent step that should be taken in light of the damaging evidence against him. Nevertheless, Health Ministry officials that run the institute they do not plan to suspend the nation’s leading pathologist at this time.

High Court Petitioned to Suspend Prof. Hiss

The Movement for Quality Government has petitioned the High Court of Justice seeking to have Prof. Yehuda Hiss, the director of the Abu Kabir Forensic Institute, suspended. The petition calls for suspending Hiss from his responsibilities as the director of the forensic institute, as well as barring him from giving testimony in court and signing official documents, pending the outcome of the criminal investigation against him.

Hiss is facing charges related to the illegal storage of body parts and organs, and the taking of the hundreds of organs and body parts without the knowledge/permission from families of the deceased.

To date, despite the serious charges against him and the ongoing investigation, Health Minister Dahan released statements that he has absolutely no plans to suspend the nation’s leading pathologist.

More Complaints Against Prof. Hiss

UTJ MK Eichler has proposed legislation to ban the performing of all autopsies unless a family member is present. The bill was prompted by a growing number of complaints and allegations against the Abu Kabir Forensic Institute and its director, chief pathologist Prof. Yehuda Hiss.

Hiss has often been accused of stealing organs and body parts, and containers of organs and body samples from civilians and soldiers who were thought to have been buried whole were found in the institute.

The most recent complaints against Hiss and the Forensic Institute were raised last week by a family in Dimona who found that their son, who was killed while serving in the army in May 2001, had been buried without some of his body parts.

Though an army investigation found at the time that the soldier had killed himself, the family complained that he had been a victim of cruel harassment and demanded a more in-depth investigation. Several weeks ago, the family removed the body from the grave, and the Defense Ministry finally agreed to another autopsy by an independent pathologist from Denmark.

The family was horrified by his findings: missing from the body were three ribs, the heart, the liver, part of the brain, and more. The parents responded with furious anguish, accusing the authorities of “stealing organs” and of “killing our son for a second time.”

The Knesset Health Committee, headed by NRP MK Yahalom, held a stormy session on the matter this morning. Taking part were Prof. Hiss, representatives of the Health, Religious Affairs, and Defense Ministries, a pathologist, the soldier’s parents, and others.

Health Minister Naveh announced the formation of a committee to investigate the case. By Jan 2002, Hiss was in fact under police investigation for conducting illegal sales of body parts as well as for removing organs from 81 deceased persons without consent.

Six months later, the Supreme Court rejected a petition by the Movement for Quality in Government demanding his suspension.

Hiss Won´t Be Put On Trial

Attorney-General Rubenstein has decided not to indict the director of the Abu Kabir Forensic Institute, Prof. Yehuda Hiss. Rubenstein found that Hiss broke no laws in providing “expert testimony” about autopsies at which he had not been present, as in any event he saw the bodies and was familiar with the findings of the autopsies.

A disciplinary complaint will be filed against Hiss, however. More controversially, Hiss had been accused of various irregularities regarding autopsies and the use of tissues and organs.

Although Rubenstein found that no autopsies were performed without permission from the families, tissues and organs were used for scientific study without the families’ knowledge. Rubenstein said that Hiss should have ensured that this not be done, and that more sensitivity need be shown to the families, but that he need not be put on trial for this.

The Attorney-General stated that even if the Institute did not act properly, “there is no suspicion of corruption or profiteering on the part of Prof. Hiss, and the only interest he had was the advancement of medical research.”

The grassroots Forum for Forensic Institute Victims is not happy with the decision. Spokesmen Porat and Barne’a said that it is a “pathological decision,” as the Attorney-General has now “buried with his own two hands the rule of law in Israel.”

The two said that the decision contrasts with a Health Ministry investigation that found that Abu Kabir under Hiss’ direction had “taken human organs and acted freely with them.”

The police agreed with the report, the Forum said, but “the Attorney-General preferred the interests of the ‘establishment’ instead of the rule of law, and has thus struck a blow at the public trust in the legal framework. If it had been a lower-level clerk, he would have been fired and put on trial for only 10% of what Hiss did.”

Former Health Minister Dahan expressed disappointment with Rubenstein’s decision: “As someone who is familiar with all the details, I was sure that there was room for a criminal investigation.” He said that there was at least one encouraging result, namely, that the questionable practices in the Forensic Institute will not continue.

Hiss Dismissal Applauded by Many

The decision by Health Minister Naveh to fire Chief Medical Examiner Prof. Yehuda Hiss was applauded by the Movement of Quality Government along with other public and elected officials.

Movement for Quality Government officials in their media release pointed out they have been working for three years to point out and document the irregularities and mounting complaints against Hiss, ranging from alleged removal of organs without permission of family members and performing unauthorized tests and other procedures on bodies. There are also cases dealing with alleged perjured testimony and irregularities in reports.

Health Minister Naveh has announced the firing of Prof. Yehuda Hiss from his position as Director of the Abu Kabir Forensic Institute.Hiss will remain Chief Pathologist at the Institute, however.

Hiss has been involved in many controversies over the past several years, including unauthorized use of body parts for research and other purposes. This past December, then-Attorney-General Rubenstein aroused objections from several directions in deciding that Hiss should not be charged with criminal behavior.

Rubenstein said at the time that Hiss had broken no laws in providing “expert testimony” about autopsies at which he had not been present, nor in having used tissues and organs after autopsies without permission from the families of the deceased.

Minister Naveh said yesterday that Assaf HaRofeh Hospital Director Davidson will take over the managerial responsibility for Abu Kabir. Parents of children whose corpses were mutilated in Abu Kabir expressed deep satisfaction with the decision, though some said that Hiss should be forced down from his position as Chief Pathologist as well.

Infamous Chief Pathologist to Once Again Evade Punishment

According to the arrangement, the prosecution will request that Prof. Hiss receive only a reprimand for his involvement in the unauthorized removal of parts from 125 bodies. In exchange, Hiss will admit to the acts. The plea bargain is subject to the approval of the court.

In all of the 125 cases, Dr. Hiss and his subordinates removed organs, bones and tissue without the permission of, and in many cases, against the expressed wishes of the families of the deceased.

According to evidence submitted in the past, Abu Kabir had a “museum of skulls” set up by Dr. Hiss that included the skulls of IDF soldiers that had been shot in the head. He has also been investigated for selling organs and falsifying testimony.

Hiss was fired from his position as Director of the institute shortly after the courts became involved in allegations against him, but has remained the Chief Pathologist at the Institute.

This is not the first time that Hiss has escaped legal consequences for his actions. Former Attorney-General Rubenstein aroused objections from several directions when he ruled that Hiss should not be charged with criminal behavior, even though he provided “expert testimony” about autopsies at which he had not been present and used tissues and organs after autopsies without permission from the families of the deceased.

  1. The whole subject makes me feel like throwing up. But my question is, would the abused Jewish family have the same openion and stance regarding the same issue when Palestinians are conserned. I doubt it,because in my mind all Jews are double-standard people; I mean hypocrate and self-concieted.

  2. The whole subject makes me feel like throwing up. But my question is: would the abused Jewish family have the same opinion and stance regarding the same issue when Palestinians are concerned. I doubt it, because in my mind all Jews are double-standard people; I mean hypocrite and self-conceited.

  3. I doubt they would. There is a Palestinian man who a few months ago, when his very young son was shot by a sniper offered his son to anyone who needed the parts who suited. Awhile later he went to visit the different families to "visit his son".

    He was a lovely man. 4 parts went to Jewish kids and 3 to Palestinians. One Jewish family welcomed him as family and said they tell their little girl, about 3, that she is now part Palestinian because of the boy. That was a very beautiful thing.

    The Palestinians were of course thrilled and all was as it should be.

    But the other Jewish folks? Two just out and out said, it would do, but they would have rather the organs been Jewish! The last was grateful but only lukewarm.

    The father just was happy to see life come from the loss of his son. But the ones who wished they had been from Jews were the Haredim, the hard core group. No surprise there.
